and we're sharing what we've learned, so we can all produce energy more safely. our commitment has never been stronger. right now, security at the nation's airports now under federal review following that deadly shooting at lax. the latest on what attorney general eric holder revealed today. democrats hoping for a big win they haven't seen in 30 years. five major statewide offices, including a possible victory for terry mcauliffe as governor. a soldier helplessly watches over facetime as his pregnant wife is attacked thousands of miles away. but first, news nation is following developing news. the supreme court rejecting oklahoma's appeal to reinstate its strict law banning medical

abortions, specifically those performed with the drug ru486 known as the abortion pill. the court initially agreed to take up the appeal this spring but later asked oklahoma's court to clarify what the law covered. the court responded by saying the measure effectively bans all medical abortions. that apparently wasn't enough for justices and now oklahoma's supreme court decision avoiding the law will remain intact. pete williams joins us live. this is one of a number of abortion related cases and high court is expected to consider soon. >> right, but consider the importance of what the court did here. as a technical legal matter, what the supreme court did here today, no presidential value and expressed no view on the laws and said we're not going to hear this case after all. consider the fact in the spring when it looked like enthuse law in oklahoma was to restrict not to ban the use of ru486 and one

other pill for medicinal purposes the supreme court was willing to look at that. oklahoma said please take our appeal, the supreme court here says we can't enforce this law, the supreme court says yes. when the supreme court found out that the law essentially bans the use of these pills, the supreme court said we're not going to review a decision striking that down. that i would think is not a good sign to the advocates of these laws in other states. there are similar -- not identical but similar laws in texas and arizona, in ohio, and in north dakota. so the lower courts are all over the map on this. but i would think this is not a good sign for those laws, but that's going to have to work its way for a while. yes, there are other cases heading here just today there's an appeal to the u.s. supreme court, a request for it to stop the owe the effect of a appeals court ruling allowing the texas

abortion law to go into effect. the one that says doctors that perform abortions have to have admission privileges at hospitals within 30 miles. it already closed down a third of the abortion clinics in texas and want the supreme court to let the clinics stay open while that case works through the lower courts. the supreme court asked the state of texas to respond by next week. that ban will remain in place for the -- the law bill rewill remain in place for another week. >> tomorrow, two key governors races with wide ranging implications will be decided. in virginia, where vice president joe biden is campaigning for democratic candidate terry mcauliffe today, it's looking like a 30 year trend might be broken in that state. after tomorrow democrats could control all five major statewide offices. the two u.s. senate seats plus governor, lieutenant governor and attorney general for the first time by the way, since the

nixon administration. meantime, in new jersey, chris christie is seeking to take a page from george w. bush's playbook and emerge as an even stronger 2016 presidential candidate. governor christie aiming for the widest republican margin of victory since tom keen won 69% of the vote back in 1985. and another long-term trend could be broken tomorrow. since virginia and new jersey vote together, it would be the first time, that the two states have elected governors from different parties since 1985. a lot of history there. joining me now, nbc news senior political editor mark murray and also senior washington correspondent for politico. i'll start with you mark. let's first talk about virginia. as i said, a 30-year trend seems to be on its way to being broken. >> well, right, of course the marquis contest is the

gubernatorial race where terry mccalliffe is in the driver's seat. may be the closest contest will be the state attorney general's race between mark herring and mark o ben shane, the polling we've seen on attorney generals race is a little tougher. the polling we've seen it is very close. democrats do have the chance for a sweep. and it's significant because it's a state in virginia which has been a swing state. it's perfectly reflected the spread in the 2008, 2012 presidential races and that's what we'll watch tomorrow night. >> the poll shows mcauliffe is up 6% and also interesting to know note, mark, how much the clintons have been involved in this race and for obvious reasons as well as the president's limited involvement in the race. >> the president had a limited involvement and his people would point out because of the government shutdown, kept him from having any campaign activity in the first half of the month of the october.

there's no doubt terry mcauliffe is such close friends to bill and hillary clinton and a lot of people working in the upper esh lons have ties to the clinton apparatus. and many of these people might play a potential big role in hillary clinton presidential candidacy if she ends up running. a lot of 2016 signals here but there's no doubt that terry mcauliffe is always and will be a very good friends to the clintons. >> let me play what the president said while campaigning for terry mcauliffe in virginia. let's play that. >> you've seen an extreme faction of the republican party that has shown again and again and again that they are willing to hijack the entire party and the country and the economy and grind progress to an absolute halt if they don't get 100% of what they want. >> anna, it's interesting in politico in an op-ed it says

republican candidates continue to try to turn the race into a referendum on president obama's het care law. virginia can send washington a message we oppose obama care with our votes on tuesday. virginia can vote for me and who want to see obama care grow further can vote for mcauliffe. that's from ken cuccinelli. this hail mary as it described by our first read team is essentially to try to tie up what's happening with the health care website and some of the issues that's plaguing the administration in getting it off the ground with the race in virginia. >> absolutely. obama care continues to be dominant force right now in the race. both mcauliffe is running on it and supported it. you see on the right cuccinelli has already made it an issue saying vote for me if you don't like obama care. even obama has -- his team has said if mcauliffe does win,

saying there's a referendum on obama care and people do like this law once going forward. >> the first read team going back to -- people should check it out, both thoughts on this. you're saying that the races, particularly new jersey and virginia, it's about minding the middle and the base, which is what your headline was, mark. >> tamron, the point we were trying to make, the sign of a really healthy party, when your candidate tries to appeal to the middle that the base is not being alienated. we're seeing that with mcauliffe, making a by play to the centrist business class in virginia, at the same time liberals supporting his candidacy on all of the social issues. on the republican party, meanwhile, ken cuccinelli made a big play to his party's base but that's alienated a lot of folks in the middle. there's a substantial part of middle virginia that is key to winning presidential contests,

gubernatorial races. new jersey is even more interesting case because there you have someone -- chris christie who appealed to the middle but alienated the tea party base. his numbers with the tea party republicans is actually gotten worse over the past six months. that is a predicament the republican party finds itself in. good news, they have lots of time before 2016. >> they have lots of time but we know time flies and we're looking at and we'll talk more about chris christie and his strategy if he plans to run for president, with tea party republicans have seen a significant drop. even when the president was in new jersey, he was seen with chris christie and not in a one on one with the democrat running against him. >> absolutely. one of the starkest thing you look at the contest here in virginia, the amount of support mcauliffe has gotten from establishment democrats and president and clintons, where in

new jersey, everybody in the democratic side has stopped and not weighed in. even the spokesman had a hard time saying whether or not he supported the new jersey democrat for the race. certainly i think everybody expects chris christie to win. as somebody who in this administration has been looking for people to compromise. chris christie could be that kind of candidate for hem. >> anna and mark, thank you both. we'll be talking about it. we're also following developing news from the senate where a critical vote is expected tonight on a politically risky bill to outlaw workplace discrimination against gays and trans gender employees. the employment nondiscrimination act would be the most substantial gay rates law passed by congress since the repeal of the don't ask, don't tell policy. today nevada's dean heller became the fifth republican to publicly back this bill. his support means the bill has

the 60 votes necessary to clear procedural hurdles in the democratically controlled senate. as ben jacobs writes it's, mark pry or may face the toughest re-election campaign of any incumbent senator in 2014. he's running against conservative rising star tom cotton in culturally conservative arkansas, a state that is becoming increasingly difficult for democrats. luke russert joins us from capitol hill. luke, as pointed out in those two examples alone, this is a risk but looks like it's moving forward and the president said he will sign it. >> reporter: it's moving forward, tamron. there's a cloture vote scheduled in the united states senate, that's a procedural vote of which they now have 60 saying they move it forward and final vote sometime this week. however, after this announcement came out from mr. heller that this would go to cloture this

evening. john boehner releasing a statement that throws a wet blanket on this enthusiasm on a lot of folks supporting enda have, saying the house will not move on this. they view it as something that would allow for frivolous lawsuits that would hurt small business. they've said a this a lot, that house republicans are saying, there is not anything new. we oppose this legislation, not based on the actual people that will be affected, but because what it could do it to business. specifically those involved in religious community that oppose gay marriage and gay rights, also as hertage action that very strong outside conservative group which said they would score the vote if you voted for enda, you would be infringing on the individual liberties of businesses to carry out how they want to carry out their practices. this is something that will face a death in the house gop

confidence, much like a lot of these controversial bills have come out of the senate, things like immigration. what's very interesting tamron. back in 2007, this passed the house with 35 republican votes. republican charlie dent of pennsylvania, a moderate said he wished if -- go forward on house floor because it would get republican votes, maybe not enough to pass but an issue where you're saying, 2012 the rnc said this making ourselves more viable to young americans. they are going to throw a wet blanket on it. >> if the house proves to be a roadblock again, what has the house said regarding an executive order? >> reporter: regarding executive order, that will be interesting to see. i haven't covered the white house aspect with that so much, more involved with congress. you would hear an outcry from the house speaker john boehner as well of a lot of republicans sub seeding his authority there. >> jay carney was asked the

welcome back this morning. attorney general eric holder announced a review of security at airports as parts of the investigation of what happened at los angeles international airport. police reveal new details on what may have motivated chiancia, he remains sedated under an armed guard. they are focusing a note in his duffel bag that reveals he planned a suicide mission and claiming the tsa vi litted his

constitutional rights. one officer, hernandez was killed and two others wounded along with one civilian. jennifer yorkland joins us live with what investigators have learned and also i understand a statement from an attorney representing the family is out or due to be out soon here? >> reporter: yes, tamron, in fact we just heard from the family attorney who read a prepared statement just a few minutes ago. take a listen. >> we like most americans are shocked and numbed by the tragic events of last friday. we acknowledge the need to understand what happened and why it happened. and to that end we as the ciancia family have cooperated with law enforcement agencies with the last several days. it is important to express our

deep and sincere sympathy -- >> reporter: you can see here at lax, paul ciancia open fire at the bottom of the stairs where flowers are where the tsa agent fell. he went up the escalator and turned around because he saw he was moving and fired again according to officials. but the 23-year-old accomplished two of his goals when he came here to lax, not the suicide mission part but did want to kill a transportation security administration officer and also to show how easy it is to get a gun into the airport. and this could very well lead to changes in how airport security is run as we heard from eric holder earlier this morning. again, ciancia was shot four times, at least once in the mouth. he's sedated under heavy guard and still in critical condition. we do know he was unemployed motorcycle mechanic who just recently moved to los angeles from a small town, a blue collar town of pensville, new jersey.

although he was dropped off here at lax by a roommate, we are told he most likely operated alone, that the roommate who dropped him off curbside at the door behind me at lax, was not in on it and did not know why he wanted to go to airport, there was talk that his dad was sick and drop me off at the airport, he was really anxious to get here on friday. so that roommate we are told probably most likely not going to be charged. >> thank you very much. we'll talk more about security, not only at lax but all airports. dan, you wrote about this issue and the headline points, pointing to gaps in post 9/11 secure despite though as you pointed out the millions of dollars invested into improving the situation, there are so call soft spots revealed after the shooting. >> yeah, two of the main things that emerged from the shooting are that a lot of public areas

of the airport, the lobbies and ticket counters and sidewalks, even down in the baggage claim area is easily accessible to anyone basically. there have been reports, studies done showing that they are vulnerable to car bombs and luggage bombs and anybody who wants to bring in a gun concealed in a bag or luggage. the other issue that's emerged is the removal of armed police officers from these tsa checkpoints. and had one been present at this, that officer might have heard the shots below. there's a stair way below the tsa checkpoint here. that officer might have heard those shots, called in for backup and everything and you know, laid out the location then engaged the suspect right there at the checkpoint. he wouldn't have been able -- probably wouldn't have been able to run through the checkpoint down the corridor and into the

passenger gates. >> i said millions spent on improving security, it was actually $1.6 billion investment. >> 1.6 billion. >> the officers moved, they were shifted from their assignments as you note in your article, to checkpoints in patrolling inside and outside of passenger terminals and in your piece you've written here, there of course is no guarantee even if the officers were at the check points, that this could have been avoided and you note an incident at lax back in july of 2002. >> there's the shooting in 2002. according to law enforcement, the shooter in that waited until the police were gone. but, yeah, no system is perfect. but, i mean, sure, the shooter could have taken out the officer at the checkpoint. but then again the other scenario is in this case, he could have hurt -- easily heard the shots. and the stair way is right below his position. so i mean, it might have been a

lot better outcome in which case there would have been less disruption at the airport. >> let me play a little bit of what eric holder said regarding this review as a result in response to the shooting at los angeles international airport. let's play that, please. >> folks at tsa to ensure that people can board planes safely, take flights safely. the responsibility for protecting airport security is not a tsa function but something we need to certainly examine, given what happened in los angeles. >> dan, back to your article where you pointed out the greatest threats to airport terminals are between the curbs and street and passenger screening areas. this is not just lax but applicable to many of these major airports which we will see a great influx of people over the next couple of weeks with the holidays. >> correct. and i think this situation is going to be reviewed. i mean the head of the tsa union called for the return of our

geico. fifteen minutes could save you...well, you know. anybody? a georgia judge is expected to rule if there will be a coroner's inquest into the death of kendrick johnson, who was found inside a rolled up wrestling mat early this year. the johnson family brings their son was murdered and have disputed official findings by the sheriff and the coroner that his death was an accident. johnson's parents asked for the inquest last month after the coroner refused to reopen the case. gabe gutierrez is in atlanta with the latest. do we have a better time line when the judge can make this ruling here? >> hi, there, tamron. we're monitoring developments and are awaiting that ruling that would show whether or not that coroner's inquest would move forward. what exactly is a coroner's

inquest? it's a judicial proceeding where six jurors would take a new look at evidence in this case and decide whether kendrick johnson died as a result of an accident as officials have said or perhaps as a homicide. now, kendrick johnson's family requested this coroner's inquest about two weeks ago, wanting to see if something -- if officials would take a new look at this case. as you mentioned, the georgia bureau of investigation ruled kendrick johnson died in a tragic incident when he reached for a shoe, fell in, got stuck and could not breathe. now, last week, the u.s. attorney opened a formal review into this case. that could take a while. this coroner's inquest would be significant because it would essentially reopen this case on the local level in addition to the federal law, now in addition to that, we're also awaiting the release of 1900 hours of

additional surveillance footage that a judge ordered to be released last week. only less than a minute of surveillance video was released and the sheriff's office said that to handle the sheer volume of this request. we could see the footage tomorrow or wednesday. right now we're waiting for the result of the judge's ruling into the coroner's inquest. >> we'll bring our audience the latest as soon as we hear this ruling, expected sometime today from this judge in georgia. still ahead, a new york university student is recovering in the hospital after being trapped between two buildings for almost two days. how this happened, details in the "news nation." a texas coach who collapsed walking off the field in the game, we'll have details. more on tomorrow's votes for governor of new jersey and what the outcome to mean for the 2016 presidential race. the republican governor is aiming for a landslide victory in the democratic state to show he could be strong gop kand date come 2016. one poll shows a 63 points and another at 31 points. when asked if he's trying to send a message beyond new jersey, here's what he said. >> i think it's inevitable. i think people look at actions and try to discern things from what they mean at that moment and what they mean for the future. and i think that what people will see is so unusual for what our party has created in the last couple of years, that invariably people -- i hope they

do. >> back with us mark murray. didn't get specific in the message, what do you believe the message is christie wants to send, not just nationally but specifically to his party. >> the message is that i'm a winner and big winner. at a time we lost the two straight presidential contests, it looks like we're going to end up losing virginia's gubernatorial contest, i can win. i can win in blue states like new jersey, one that president obama won by 17% points in 2012. that's the message he'll be able to try to send. but it conflicts with the different message that has a lot more resonancecy, that is an ideology matters more than likability. we'll see this fight within the republican party between electability and ideology battle out over the next year, year and a half, it will be interesting to see which side is ahead come the summer and fall of 2015 and into 2016. >> mitt romney did not pick

chris christie to be his running mate but he was on "meet the press" singing christie's praise. let's read what he said about the future and 2016. >> paul ryan, jeb bush, marco rubio, there's a long list of capable people but chris christie stands out. >> does ted cruz stand out as a potential -- to the republican party? >> look, i'm not going to disqualify anybody, but i think i've indicated some of the names i think are most effective and becoming elected. >> there you have it, could not have been more clear what he thinks of ted cruz. with chris christie, it's interesting because he praised him heavily and did not pick him and now you have a new book talking about the alarm bells and things that concerned romney about chris christie that could play a role in 2016. of course the book is "double down". >> he's probably glad mitt

romney did not pick him. there was a political grave yard who's ticket ended up losing the presidential contest. i don't think we would be talking about chris christie if he had been part of the losing mitt romney ticket. you are right, the new book out, double down has research that came from the romney campaign that -- some of the problems why chris christie wasn't picked and tamron, i'll emphasize how important this was. this would be the equivalent of john kerry after his 2004 presidential campaign ended up leaking out opposition research regarding barack obama or hillary clinton to kind of detail. this is why we didn't pick up this person. that's not very good for chris christie going forward. it has a storyline, there are skeletons in his closet and things -- >> even bernie madoff's name comes up in this. >> exactly, tv ads that will potentially be out there, that

the pregnant wife of a u.s. soldier attacked while the couple was facetiming, has delivered a healthy baby girl, 31-year-old rachel pool was rushed to the hospital in critical condition after she was stabbed multiple times as her horrified husband watched and could hear her screams for help. two days later, doctors performed a successful c-section. poole was attacked by cory moss, a soldier who allegedly owed her husband money. from my show, deadline crime, michelle, when i first saw this headline,y think it was real. you cannot think of a more horrific thing to happen. what are police saying beyond they think it had something to do with money. why did he attack her? >> you know, i spoke with the detective, tamron, about 20

minutes ago from the el paso -- police department in that area. what he tells me, he believes that moss was waiting for rachel to get home before he allegedly attacked her. that's number one. number two, it is because from what he believes and what he has learned from the investigation that moss, you see him there on the screen, did in fact owe the family some sort of money, possibly over some sort of car repairs. you also have to think in all of this tamron, thank goodness she was chatting with her husband in all of this. i know it was a horrific sight for him to see, but thankfully he was able to get messages out and she was able to call 911. there is a little silver lining and that precious little baby, the biggest piece in all of this. >> police say she -- obviously there was some -- the family knew the suspect, that she repeatedly screamed his name to

her husband? >> she did. she screamed his name to her husband. she was not only stabbed. she may also have broken bones. she was nine months pregnant at the time, scheduled for a c-section next week. and they had to just as you mentioned, deliver this baby c-section, take this child who is now very healthy, thankfully, dad, justin, has come back from asia, back in the united states with his family. there with his wife and daughter. so hopefully she will just make a full successful recovery as all of this. as for cory moss, 19 years old and in the army. i spoke with the district attorney's office in the el paso area, what they tell me is the case is not been given to them fully yet but once they have it, they'll present it to the grand jury and the grand jury will bring down hopefully an indictment. >> friends of the family started a fund raising effort to raise money for the family. they have it online. they've raised last count we

have around $5,900. so they are trying to help out in something that is just beyond belief that this could happen. thank you very much, michelle for those details. we certainly hope she recovers, rachel and the baby, all okay. the dramatic rescue of a new york college students tops our looks around the "news nation." asher vongtau reportedly fell into a narrow space between two builders saturday night. the nyu student spent over a day in the small 2-foot wide space before being discovered by police. firefighters had to break through the wall of a parking garage to get him out. how he fell remains under investigation. vongtau is expected to make a complete recovery. survivor michelle knight is speaking out about the horrors she endured in her ten years of captivity in an exclusive interview with dr. phil that will air this week. knight describes becomie ariel

income. women must make and the support they will need. joining me now, ceo of safe horizon, behind the real safety domestic violence conference. thank you so much for joining me. >> thank you. >> this is controversial, you have family and friends, for example, who are trying to do interventions. and when that person who is the victim of domestic abuse doesn't leave, sometimes the reaction is to throw their hands up and assume that the person wants to stay in that relationship. >> well, it's all a matter of choices and realities. for someone who is in a very violent situation, very often the batterer exerts financial control, she's deciding whether it's better to stay or be homeless. that's the kind of choice victims that we serve at safe horizon may be faced with. >> i've spent time in shelters with women who are helped because they are the victims and you see them with their children, some of them were

stay-at-home moms. you know, to say it breaks your heart is minimizing what it does to you emotionally. you can't imagine what's happening with that woman. what kind of resources or what advice is given to someone in that situation? >> well, for someone in shelter, there's a whole range of services or not in shelter, a whole range of services we can provide, including safety planning, and part of safety planning is economic safety planning as well. do i have all of the documents i need? can i get job training maybe and allow me to have more economic freedom? one of the tools abusers use to assert control over their victims is financial control and emotional control too. you would be nothing without me. you could never work. who would want you. so those are some of the messages that we help to counteract at safe horizon. >> as you're doing that to counteract, you have this scenario where that person is told, just leave. as if it is that simple as if it

is as black and white as those words just leave. for some women, the time when they leave can be the most dangerous time in their lives. there are some women in such terribly abusive situations that they say i know if i leave now, he'll kill me. for those women and others, let's help them find ways of improving their safety and having strategies that can get them to the point where they can one day be really safe. >> this is one of the more controversial topics that will be addressed at the conference. >> right, because traditionally as you said so eloquently yourself, everyone's first idea is just leave, go to shelter, just go. someone may -- a victim may have loved this abuser, they may have children together. he may be a good provider, weaver talked about, maybe one of those children is a special needs child in a great placement in school. maybe her mom babe sits in the afternoon so she can work. leaving means leaving all of that behind. it may not be the right decision
